Nine Senators will be voting tomorrow at 3 pm Mountain Time regarding clarification of the existing law.
While existing law allows parents to submit a written statement regarding their legal right to refuse some (or all) vaccines for their child prior to daycare/preschool/school enrollment, the Idaho Health and Welfare Department is refusing to accept it. And instead forces families to complete a 2-page form designed to make parents state that refusing vaccines puts their child and others around them in danger, and their form could be used to prove 'medical neglect'. In addition the form intentionally forces parents to waive their right to privacy in the reasons they choose to opt out of vaccines. It also violates a family's legally protected right to opt out of the state vaccine registry - IRIS.
This is a blatant discrimination against families.
The Vaccine Exemption Clarification Bill will add specific wording providing clarification to the existing statute. This will require that Idaho Health & Welfare Department comply with laws already in place regarding vaccine exemptions, vaccine reporting and school admission.

THE BACKGROUND:
Health Freedom Idaho has been working with a Senator and the legislative bill writers and have written a modification to the statute regarding the Vaccine Exemption Form. We found out just this morning that the bill has to be introduced in committee TOMORROW. This was completely unknown until a meeting this morning.
Regardless of what types of medical treatments a parent chooses for their child, or chooses to opt out of, all kids in Idaho have the right to attend public school. This includes vaccines. The state cannot discriminate or deny a child access to a public education based on vaccine status or any other medical condition or treatment.
The statutes are very clear on the requirements for invoking your right to exemption.
Idaho code 39-4802 section 2 states:
“Any minor child whose parent or guardian has submitted a signed statement to school officials stating their objections on religious or other grounds shall be exempt from the provisions of this chapter.”
Currently the IDHW is forcing parents to use only their form in order to enroll in daycare or school. This form falls WELL OUTSIDE the scope of the Idaho statute. Clarification is needed to keep IDHW in check.
