SB18 California

First came AB2109, and people were apathetic, and it became law - designed to destroy free thinking. Then came SB277 and SB792, and everyone thought surely those won't pass, but both became law - designed to destroy children. Now there's SB18, which sounds so pretty and sweet - yet is designed to destroy the family unit. How far down the fascist road will we go before it's too late to galvanize and stop an out-of-control tyrannical government?

I didn't think sb277 would pass but it did. I need Cali parents to be aware this new bill is terrifying. Please feel free to tag anyone and help make them aware. If this passes I'm done with Cali. Looking at Texas and Idaho still!

I keep bringing up sb18 to parents and so many don't know what I'm talking about. So here it is....
There's a new bill that threatens parental rights in California (and the rest of the USA if it passes) called SB18. Some highlights:

• Law states that child’s expectant mother must access “appropriate pre-natal care” and parental training (what does that mean? Must be in a hospital? Not defined)

• Law states that child’s parents access evidence-based “voluntary” home visitation programs to support “positive parenting” which includes “improvements in the coordination and referrals for other community support”

• Law states that child has the right to access high-quality education (MANY more lines defining what this means, all of which could be construed as anti-homeschool)

• Law states that child has the right to “appropriate medical screening services” including comprehensive medical history, blood tests, and “health education”

• Law states that child has the right to “dental, medical, and mental health services” administered by a qualified physician (read: AMA approved, not naturopath) and drugs/treatments that they prescribe

• Law states that these health services will be offered within the school system (so you won’t be there, as a parent, when they are administered)

• Law states that the CHILD (not the parents) will have access to appropriate legal representation in legal proceedings to represent the interest of the child

• Law states that parents/other adults consider the effect that their decision making will have on their care and community

• Law states that the parents must obtain employment opportunities that promote a healthy work/life balance (WTF? Who defines what this is? How do you enforce it?)

• Law states that child has the right to be with his parents *if appropriately cared for as defined by this law*

• Law states that child has the right to be with his parents *except when authorities determine separation is in the best interest of the child*

• Law states that the state will take custody if the parents *do not adopt the responsibility for upholding the rights defined in this law*

[Vaccination-Liberation] California's "Personal Beliefs Exemption" form

Part of a discussion on Vaccination Liberation group....

An addition to what I wrote below is this story out of Idaho  http://www.ktvb.com/story/news/health/2014/10/21/meridian-mother-upset-after-vaccination-program-mix-up/17647133/The
This woman did NOT give her consent for her 8 y.o. boy to receive the flu mist. As you can guess, the school is released of liability since she did not present the school with a Vaccination Notice and force the liability issue. With schools being used as Vaccination Clinics AND the school being released of liability unless YOU as the parent force the issue, this becomes more important than ever for people to wake up to our 'legal reality' and act accordingly.

Hi Gary, Joan, AL, Sheri, Natalia and the rest -

Since the law changed last legislative session, the attached form is what THE CALIFORNIA DEPARTMENT OF PUBLIC HEALTH claims is required for daycare and school attendance. But according to the way the law is written - see http://www.leginfo.ca.gov/pub/11-12/bill/asm/ab_2101-2150/ab_2109_bill_20120831_enrolled.pdf  Noting Section 1, (b) (2) and (d), parents have every right to create their own statement and have their practitioner write a statement and completely revise their form. You can bet that BAR licensed attorneys who don't want their children vaccinated would be utilizing these sections.
Not everyone gets on Facebook and for a multitude of reasons. I totally agree with AL and would be challenging this through creating a Vaccination Notice. There are several ways I would be altering the template that AL provided for a Vaccination Notice on her website here http://parentsagainstmandatoryvaccines.wikispaces.com/DO+NOT+SIGN+the+Refusal+to+Vaccinate+Form!!#x-*THE%20VACCINATION%20NOTICE
Namely it should be noted that all the health care practitioners authorized to indoctrinate parents are also authorized to prescribe and administer pharmaceutical drugs. While naturopaths are included, only those naturopaths who are licensed to prescribe and administer drugs under the supervision of a physician or surgeon can provide the exemption information.

We talked about this very issue on our radio show Saturday night. With Common Core and Vaccination clinics being set up in all the schools, it is simply too dangerous on ALL levels to put your children in school. Just recently I was talking with a friend and we were noting a few brilliant young people who have come out as strong leaders in our area. What we both found interesting is that all of them were homeschooled.

Patriarchy reaches new high in California

From Gary Kranser...

Before you may act on your determination concerning your child's health, which conflicts with what the state of California feels is right for your child, then you are required to listen to a lecture from someone who the state of California believes holds greater wisdom than you do.

That's the essence of a new law, for which hearings were held yesterday

http://www.nvic.org/NVIC-Vaccine-News/June-2012/doctors-slam-parents-for-vaccine-choices---fda-lic.aspx

Perhaps one thing the sponsors of this bill hadn't considered was that a parent just might consult a health practitioner----to obtain "information regarding the benefits and risks of the immunization and the health risks of specified communicable diseases"----who happens to oppose vaccination. Such a clinician would likely suggest more "risks" associated with vaccination than "benefits".
Nevertheless, the bill itself is just another step towards big government control over our lives. The end of Federalism, as today's Supreme Court decision on "Obamacare" exemplifies. We learned today that there is no limiting principle in applications of the Commerce Clause (if government can get away with capriciously and laughingly define it as a tax) according to the majority, and according to some California legislators, there's no limiting principle to supersede freedom of conscience and religion.

Oh sure, you will get your freedom of conscience and religion. But only on the condition that you listen to the government's CORRECT view on the issue.

What if you feel you had already considered all relevant issues on the matter?

Sorry, that's not enough. The government knows best and the government's own view on the matter should prevail upon you, if you are a competent parent. It's the correct view. Why else would government mandate that you listen to it?

If this law is enacted, then the next logical law to enact would be one which penalizes a parent further for not accepting the government's correct view on vaccination.

Perhaps the penalty would be a fine? (Justice Roberts would likely redefine it as a tax, just to make the law appear Constitutional.) Or maybe the penalty would be having to attend parenting classes, as many parents are forced to do when they fail to adhere to the wisdom of Children's Services----such as feeding your kids cow's milk or meat or white bread, etc.?

Quote from bill support memo:

The bill would require, on and after Jan. 1, 2014 the [exemption request] letter or affidavit to be accompanied by a form prescribed by the State Department of Public Health that includes a signed attestation from a health care practitioner, as defined, that indicates that the health care practitioner provided the parent or guardian of the person, the adult who has assumed responsibility for the care and custody of the person, or the person, if an emancipated minor, who is subject to the immunization requirements with information regarding the benefits and risks of the immunization and the health risks of specified communicable diseases.
The bill would require the form to include a written statement by the parent, guardian, other specified persons, or person, if an emancipated minor, that indicates that he or she received the information from the health care practitioner.

AB 2109 - Callifornia Families Alert from Dr Bob Sears

STATEMENT FROM DR BOB SEARS RE: CALIFORNIA ASSEMBLY BILL

California Bill AB2109 Threatens Vaccine Freedom of Choice

The California Legislature is currently considering a bill that would require parents to obtain their doctor's signature on a government form prior to enrollment in public school if they wish to skip one or more vaccines for their child. Current law allows parents to decline vaccines by signing an exemption form at the school, no doctor's signature needed. The new law would require a written statement signed by a health care practitioner that indicates that the practitioner provided the parent with information regarding the benefits and risks of the immunization and the health risks of specified communicable diseases.”

On the surface, this doesn't seem like a bad idea. It will require parents to prove that they've had an informed discussion with their physician. Most parents already have such discussions anyway. However, what gravely concerns me is that some doctors will refuse to sign this form. I know how doctors think. Many doctors strongly believe that vaccines should be mandatory, and that parents should not have the right to decline vaccines. Some doctors are willing to provide care to unvaccinated kids, despite this difference in philosophy. But now the power over this decision will be put directly into doctors' hands. He or she can simply refuse to sign the form. Doctors who oppose vaccine freedom of choice have been frustrated for years over this issue. Finally, they will have the power to impose their beliefs on their patients. Patients will be forced to find another doctor to sign the form, submit to vaccines, or get kicked out of public school.

Supporters of this bill believe that all doctors will be willing to sign this form, as the signature does not imply agreement with the parent's decision; it simply signifies that the doctor has provided the parents with information regarding the pros and cons. I disagree. I know for an absolute fact that some doctors will not sign this form out of principle or over fears of liability.

Parents will be forced to doctor shop for another doctor to sign their form. This won't be easy. Some doctors are reluctant to take new patients who don't vaccinate. Many doctors will be unwilling to sign an exemption form for a new patient or a patient who is only there for one visit (just to get the form signed). Some doctors get financial incentives from insurance companies for having high vaccination rates into their practice; seeing patients to get their form signed will put such bonuses at risk. How many doctors will parents be expected to call?  How many nos  will a patient need in order to be allowed into school? Natural and alternative health care providers can NOT sign the form; it must be a regular medical professional. Some families only see naturopathic or holistic health care practitioners instead of pediatricians. These families will have a difficult time getting the form signed.

And what will happen to those kids who can't get their formed signed? They will be denied entry into public school.

The sponsors of this bill may have some good intentions, as their primary public reason for the bill is to make sure that parents who don't vaccinate their children are making an informed medical decision under the guidance of their doctor. But it isn't difficult to see the REAL reason for the bill: to increase vaccination rates in our state by making it more difficult for parents to claim the exemption. But whatever the reason, this bill will likely NOT increase vaccination rates, nor will it create closer partnerships between doctors and patients. It will create anger, financial hardship, animosity, and further mistrust in our medical system.

For those patients who CAN find a doctor to sign their form, these doctor-patient lectures are not going to increase vaccination rates: Parents who are seeking a doctor’s signature have already made up their mind. The doctor isn't going to change it during a ten minute discussion. The time for a doctor to influence parents' opinion and trust of vaccines is during the initial well-baby checkups, years before such exemption forms even come into play. By the time a child will enter school, the parents have made up their mind to decline vaccines. A lecture from a doctor at this point won't matter. It's a waste of everyone's time and money. At a time when we are trying to decrease health care spending, this bill will add millions of dollars of extra health care visits for families every year. If this unfortunate bill passes in California, the rest of the country will be soon to follow.

And it's a government intrusion into our personal freedom to make health care decisions for our children.

There are numerous other objections to this bill:

* It will cost the parents, or their insurance company, more money for the extra appointments. This could cost our state millions of dollars in extra health care costs every year. We are trying to DECREASE health care spending, not increase it.

* This bill may seem like it is designed to create a closer partnership between physician and patients. Instead, it will create more animosity between parents, doctors, and schools, amid a climate of vaccine controversy that is already volatile.

* Be aware that the legislators who are sponsoring this bill have received campaign donations from vaccine manufacturers.

* Enrollment in public schools may decrease, which will in turn decrease public school funding.
